The Penthouse Executive Club fires back at the former cocktail waitress who’s suing the strip club. According to sources Lourdes Garcia “was terminated as a club employee in December 2009 when she was caught overcharging customers and stealing from the club.” The strip club has also vowed to counter-sue Garcia for defamation over what they call “spurious allegations of sexual harassment” . Garcia initially claimed she was canned for complaining about being hit on by bosses of both sexes, but has now quietly withdrew those charges .Her updated class-action complaint only alleges that she and other workers weren’t paid minimum wage or overtime.
In its Manhattan federal court filing, the strip club insists that it pays its employees for all the hours they work, noting that “Garcia earned almost $300,000 over the approximately four years she was employed at the club.Club lawyer Jeffrey Kimmel said. ““This is Ms. Garcia’s second bite at the apple in trying to find something to claim against The Executive Club. Her changing stories are evidence of the lack of merit of her claims.”
