In a surprising move the New York Transit was ordered to pay a staggering 7.5 million dollars to two Brooklyn women last week for a bus accident which took place in 2005, said the lawyer for the two women.
Brenda Whaley and Amanda Wade were riding in a car on Ocean Parkway near Avenue U in Brooklyn when a city bus, which had jumped a red light, smashed their car.
The bus driver had alleged that Brenda and Amanda were responsible for the accident, NYC Transit backed their driver, and both the parties went to court where a jury found that the bus driver was responsible for the crash. The jury awarded the two women 7.25 million and 250,000 dollars respectively.
What is strange about this case is that the NYC Transit is heavily cash strapped and had a very good chance of settling this matter once and for all three years back but didn’t do that. Instead, they went to court without first knowing who was guilty.
The attorney for the two women Mr. Herb Subin said that his client had suffered horribly and had not been able to get the care that she needed. He said that this case was a satisfactory victory but at the same time, he upbraided the Transit Authority for not acting reasonably before and saving millions of dollars. He further said that as a citizen he was outraged at the behavior of the Transit Authority.
A spokesperson for the NYC Transit said the agency planned to appeal the verdict of the case and declined to comment any further.
