Federal Judge has turned down plea by two smokeless tobacco manufacturing companies to stop the implementation of a new law which restricts the sale of flavored tobacco products in the New York City
U.S District Judge Colleen McMahon turned down a motion for preliminary injunction on Monday which was filed by the two smokeless tobacco product manufacturing companies Smokeless Tobacco Manufacturing Company and Smokeless Tobacco Brands Incorporated. Both these companies are a part of Altria Group Incorporated.
After Mayor Bloomberg signed an ordinance, which banned the sale of flavored tobacco products that excludes cigarettes anywhere other than a few select tobacco bars in the city, the smokeless tobacco maker sued in December.
City officials defended the ordinance saying that the flavored products would be more appealing to children as well as young teens and said that flavored tobacco products might get them hooked to tobacco at a young age.
The ordinance was in effect from February 25 but it is not implemented in the city at the moment as the health department is still implementing the regulations.
New York City Counsel Michael Cardozo applauded the judgment and said everyone involved in the formation of the law were only trying to improve the health of the NY residents.
Altria attacked the city saying that they didn’t believe that the city could had the sufficient authority to impose the product standards it sets and that they will continue to fight the matter in court. A spokesperson for the Altria group said that this decision is not a final judgment on Altria’s claim.
